Terms of Service
1. Agreement
These Terms of Service govern access to and use of ByteSize VMS. By creating an account or using the service, you agree to these terms on behalf of yourself and, where applicable, your organization.
2. Subscription and Billing
Access to operational features requires an active paid subscription. Billing is processed by Polar and renews automatically until canceled. Fees are non-refundable except where required by law.
3. Acceptable Use
You may not use the service to violate laws, process data without authorization, interfere with system integrity, or attempt unauthorized access to accounts, devices, or infrastructure.
4. Customer Data and Security
You retain ownership of your customer data. ByteSize VMS processes that data to provide the service and applies administrative, technical, and organizational safeguards appropriate to the nature of the platform.
5. Compliance Responsibilities
The service includes compliance-supporting controls, but your organization remains responsible for configuring policies, user permissions, and operational processes in accordance with applicable laws and internal requirements.
6. Service Availability
ByteSize VMS may perform maintenance, updates, and security changes. We aim for stable availability but do not guarantee uninterrupted access.
7. Termination
Either party may terminate for material breach. On termination, access is removed and data handling proceeds per the Privacy Policy and Data Processing terms.
8. Disclaimers and Liability
The service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, ByteSize VMS disclaims implied warranties and limits liability for indirect, incidental, special, and consequential damages.
